CHA Comments on Proposed Changes to Stark Law
For CEOs, CFOs, chief legal counsel, government relations staff

CHA has submitted its comment letter on the Centers for Medicare & Medicaid Services’ (CMS) proposed rule to modernize regulations under the physician self-referral law – also known as the Stark Law. While CHA generally supports many of the provisions outlined in the proposed rule, additional changes are needed to advance the shared goals of care coordination and reduced administrative burden.

State Releases Guidance on New Law for Determining Independent Contractors

Yesterday, the California Labor and Workforce Development Agency released a web page focused on Assembly Bill 5, the bill that creates a new test for determining independent contractor status. The site includes information for employees and employers, including frequently asked questions. Although many questions remain, this new resource may be helpful to hospital leaders as they review their independent contractor relationships.

CHA Issues Updates on Federal Wage and Hour Regulations Relevant to Hospitals

Over the past several months, the U.S. Department of Labor’s Wage and Hour Division (WHD) has finalized two significant regulatory packages — one pertaining to the salary basis test used in determining exempt status, and one pertaining to calculating the “regular rate” or overtime rate for non-exempt employees.

Jenifer Nyhuis Receives Šimanek Distinguished Service Award

Jenifer Nyhuis, CEO of Vista del Mar Hospital in Ventura, was presented with the 2019 Šimanek Distinguished Service Award on Dec. 9 during the 14th annual Behavioral Health Care Symposium in Riverside. Named for its first recipient, attorney Joe Šimanek, the award recognizes outstanding leadership and achievements in the behavioral health setting.

The Department of Health Care Services (DHCS) has released its Expanding Access to Integrated Care for Dual Eligible Californians proposal for public comment. The proposal outlines the department’s transition plan within the California Advancing and Innovating Medi-Cal (CalAIM) initiative, related to discontinuing the Cal MediConnect pilot program at the end of calendar year 2022.

The Centers for Medicare & Medicaid Services’ Quality, Safety & Oversight Group reminds providers that online training is available to help surveyors and providers prepare for upcoming surveys. Online courses, web-based training, and video webcasts can be viewed on the Integrated Surveyor Training Website.
