A clarification of policy from HHS Secretary Kathleen Sebelius suggests hospitals can help uninsured patients pay for private insurance through the new insurance exchanges without violating the federal anti-kickback statute. The decision, contained in a two-page Oct. 30 letter from Sebelius to Rep. Jim McDermott (D-Wash.) says HHS officials consulted with attorneys at the U.S. Justice Department and concluded that qualified health plans sold through exchanges do not meet the legal definition of a federal health program under anti-fraud laws.
