Independent Contractors

As currently written, the law prohibits health care employers from utilizing most health care professionals (such as certified registered nurse anesthetists, physical therapists, certified nurse midwives, physician assistants, pharmacists, and others) as independent contractors.

Business to Business

The business-to-business section of the law has created some ambiguity around using third-party businesses to provide temporary, short-term, or long-term staffing needs. The clearest impact is on staffing agencies that provide direct patient care, as application of the business-to-business provision requires that the third-party business provide staff who serve the business, and not the business’ customers (patients). However, support or administrative services could also be impacted if one of the other factors is not met.
