Supreme Court to hear providers’ case against drugmakers

The Supreme Court has agreed to rule on a class-action case that will determine whether healthcare providers who are eligible to take advantage of a federal drug-discount program can sue pharmaceutical companies for overcharging for drugs that are covered under the program. The case concerns a 2005 lawsuit in which Santa Clara County, Calif., sued nine drugmakers claiming the companies engaged in a breach of contract when they charged public hospitals, community health centers and other providers rates that exceeded the ceiling cap of the federal 340B drug discount program.
