Rule would limit some orphan-drug price cuts

HHS issued a proposed rule (PDF) limiting orphan-drug price cuts for hospitals that are newly eligible for the agency’s 340B Drug Pricing Program.

The proposed rule, which stems from the Patient Protection and Affordable Care Act, excludes discounts on orphan drugs when used for a rare disease or condition, but not for other uses. Orphan drugs are intended to treat diseases that affect less than 200,000 people in the U.S., but are often used to treat more wide-reaching indications.
