Hospital groups urge CMS to maintain current EMTALA policy

The nation’s hospital groups have sent letters to the CMS urging the agency to maintain its current policy on applying the Emergency Medical Treatment and Active Labor Act, or EMTALA, to hospital inpatients. Earlier this month, the CMS asked for public comment about possibly issuing a proposed rule that would revisit two EMTALA policies, also known as the “anti-patient-dumping statute.” On Monday, the Federation of American Hospitals offered its public comment (PDF) on the matter, saying the current policy is consistent both with the history that led to EMTALA, as well as the goal of Congress in enacting it, which is to ensure that individuals with emergency medical conditions not be denied emergency, life-saving services.
