Autism therapy lawsuit hearing delayed

Court action on an HMO industry lawsuit over a controversial therapy for autism will be held Aug. 25 in Sacramento Superior Court. A hearing scheduled July 29 was continued to the August date. No other action was taken. The lawsuit filed by the California Association of Health Plans alleges the California Department of Managed Health Care has no authority to mandate coverage for applied behavioral analysis — only the Legislature can do that. The complaint seeks a summary judgment to invalidate the policy.
