The final amended regulations answer numerous questions that have arisen under these laws. For example, the Pregnancy Disability Leave regulations “clarify” how the four-month period is calculated for purposes of identifying the maximum amount of leave available to full-time and part-time employees. The amended Disability Discrimination regulations now provide more detail on the interactive process. However, the amended regulations also raise new questions, such as what is meant by “perceived pregnancy.”  Hospitals should review the amended regulations, which are attached, and make any necessary changes to their policies and procedures to ensure compliance.
