U.S. Supreme Court Hears Day 1 of ACA Arguments

Today is the first of three days that the U.S. Supreme Court will hear arguments on provisions of the Affordable Care Act (ACA) that have been challenged by 26 states. Today’s arguments focused on whether the Anti-Injunction Act (AIA) bars individuals from suing over ACA’s minimum coverage provision. Under AIA, taxpayers may not challenge a tax before personal liability is determined by the Internal Revenue Service. Broad opinion by experts who attended the Supreme Court hearing suggests the justices are skeptical of the applicability of AIA and the court could decide key issues of ACA. The oral arguments were not televised; however, the Supreme Court has made audio recordings and transcripts available at Tomorrow’s arguments will focus on whether the individual mandate is constitutional under the Commerce Clause.
