SB 90 Seismic Extension Provisions Fully Enacted

The Centers for Medicare & Medicaid Services has approved the Hospital Quality Assurance Fee (HQAF) Program authorized by SB 335 (Chapter 286, Statutes of 2011). The state Department of Health Care Services and the Office of Statewide Health Planning and Development (OSHPD) report (letter attached) that approval of the HQAF Program enacts the seismic provision in Health and Safety Code 130060 as amended by SB 90 (Chapter 19, Statutes of 2011). SB 90 allows hospitals to seek an extension for seismic compliance up to seven years based on three elements: 1) structural integrity of the building; 2) loss of essential hospital services to the community if the hospital is closed; or 3) financial hardship.

 A PowerPoint summary of SB 90 is attached. OSHPD submitted proposed regulations to the Building Standards Commission (BSC) to implement the provisions of SB 90 as emergency regulations. BSC approved the regulations (attached below), which are now enforceable. OSHPD will now begin to review the SB 90 seismic-extension applications submitted by hospitals. Within the next few days, OSPHD will provide more details and a schedule regarding this process.
