Partial Delay of Two-Midnight Rule Extended by Six Months

The new Protecting Access to Medicare Act, signed into law by President Obama on April 1, extends the partial enforcement delay of the two-midnight policy through March 31, 2015. Until then, the Centers for Medicare & Medicaid Services (CMS) will not be able to conduct patient status reviews on a post-payment review basis through recovery audit contractors for inpatient claims with dates of admission from Oct. 1, 2013, through March 31, 2015. However, CMS will be permitted to continue its “probe and educate” audits through March 31, 2015.
