New Administrative Penalties Regulations Effective April 1

The California Department of Public Health has issued an All Facilities Letter (AFL) to notify hospitals that the Office of Administrative Law has approved new regulations in Title 22 of the California Code of Regulations relating to general acute care hospital, acute psychiatric hospital and special hospital administrative penalties. The new regulations, which go into effect April 1, allow administrative penalties to be issued for deficiencies that do not rise to the level of immediate jeopardy. The regulations include the methodology for calculating administrative penalties based on licensing deficiencies, as well as those based on noncompliance with hospital fair pricing policy requirements.
