IRS Issues Draft Forms and Guidance on ACA Employer Mandate

Late last week, the Internal Revenue Service released draft guidance and forms for the Affordable Care Act’s employer mandate, which takes effect Jan. 1, 2015, for employers with more than 100 employees. The guidance had been expected prior to July 4, and the delay led some business groups to question whether the administration would again push back the mandate’s implementation.

The forms included with the draft guidance are not required to be filed until 2016, for tax year 2015. However, in preparation for the first required filing of these forms, the IRS notes that employers may, if they wish, voluntarily file in 2015 for 2014. No employer shared responsibility payments under section 4980H will apply for 2014 for any employer, regardless of whether they voluntarily file for 2014.
