The Department of Health & Human Services (HHS) has finalized a rule requiring HHS and its agencies to review their regulations every 10 years using a two-step process.
First, regulations will be reviewed to determine if they have a significant economic impact, making them subject to review under the Regulatory Flexibility Act (RFA).
Regulations that are subject to review under the RFA must then be reviewed every 10 years to determine if the rule is still necessary, if it should be amended or rescinded, and if it is having its intended impacts. Regulations that are not reviewed in this time frame will automatically expire. HHS has five years to complete its initial review of regulations that meet the criteria.
The final rule is effective 60 days after publication in the Federal Register.
