Health Care Workplace Violence Regulatory Process Underway

On Oct. 30, the Office of Administrative Law initiated the formal regulatory process with notice of Cal/OSHA’s health care workplace violence prevention regulations. The regulatory package includes the proposed regulations and the initial statement of reasons. The proposed regulations are substantially similar to the draft discussion document, dated June 2015, Cal/OSHA posted to its website (see June 25 CHA News).

Written comments may be submitted through Dec. 17, the date of the Cal/OSHA Standards Board Meeting in Sacramento, and in-person comments may be made at the meeting. CHA will work with its existing health care workplace violence prevention workgroup to develop written comments. It is likely that Cal/OSHA will revise the proposed regulations after receipt of public comment, triggering at least one 15-day comment period. Cal/OSHA has indicated that it intends to adopt the final regulations in July 2016, for an effective date of Oct. 1, 2016. Hospitals are encouraged to review the proposed regulations, begin to conduct gap analyses and follow the regulatory process to ensure they are in compliance when the regulations go into effect next fall.
