Guidance Issued on Substance Use Disorder Confidentiality Regulation

The Department of Health and Human Services’ Substance Abuse and Mental Health Services Administration and Office of the National Coordinator for Health Information Technology have issued two fact sheets on substance abuse confidentiality regulations to help providers understand their rights and obligations under federal law.

One fact sheet explains what a federally assisted substance use disorder program is and how health care providers can determine whether the special confidentiality regulations apply to them by depicting different scenarios that might be encountered when caring for patients. The other fact sheet describes how the regulation applies to the electronic exchange of health care records and how a provider would need to properly disclose the information.
