Governor Signs MCO Tax Legislation, Eliminates SNF ‘Clawback’

Yesterday, Gov. Brown signed the managed care organization financing legislation passed by the Legislature earlier this week. The bill package eliminates the “clawback,” or recoupment of reimbursement for services provided by hospital-based, distinct-part skilled-nursing facilities. The recent legislation is the latest development in more than five years of CHA advocacy on this issue, beginning with the passage of AB 97 in 2011. The Special Session on Health remains open. It is not clear at this time when the Legislature will conclude the session, but CHA expects it to remain open for another few weeks.
