Final Rule Implementing Employment-based Wellness Programs Released

The U.S. Departments of Health and Human Services, Labor and the Treasury have released the attached final rule implementing employment-based wellness program provisions of the Affordable Care Act (ACA). The final rule outlines standards for both “participatory wellness programs,” which are available to a participant regardless of health status, and non-discriminatory “health-contingent wellness programs,” which reward individuals who meet a specific standard related to their health. The rule increases the maximum reward employers may offer participants and provides standards for program design of health-contingent wellness programs and the reasonable alternatives that must be offered in order to avoid prohibited discrimination.
