Federal Court Rules ACA Individual Mandate Unconstitutional; CHA Denounces Decision

The 5th Circuit Court of Appeals this week ruled the Affordable Care Act’s individual mandate is unconstitutional. The court did not invalidate the entire law, but sent the case back to a Texas district court for a decision about whether other provisions can exist without the mandate. In response, CHA issued a media statement denouncing the ruling and reaffirming its support for the Affordable Care Act.

“The latest judicial volley in the ongoing legal battles over the Affordable Care Act threatens to unravel the tremendous strides California has made in expanding access to care to the most vulnerable among us, and casts an ominous shadow over the lives of real people in communities throughout the Golden State,” said Carmela Coyle, President & CEO of the California Hospital Association.
