DFEH Issues Guidance for California Employers on Transgender Employees

Following settlement of a transgender employment discrimination case, the Department of Fair Employment and Housing (DFEH) has released guidance to California employers. The guidance clarifies that employers are required to allow transgender employees access to restroom, locker and other facilities in accordance with the individual’s gender identity. The direction from DFEH conforms to the April 2015 Equal Employment Opportunity Commission’s decision under federal law, and is consistent with the Guide to Restroom Access for Transgender Workers publication released by the Occupational Safety and Health Administration in June 2015.
