Court Rules HHS Can Enforce New Liver Allocation Policy

A federal court has ruled that the Department of Health & Human Services can enforce the new liver allocation policy — the Acuity Circle Model — while a pending lawsuit is in federal court. CHA has long supported this important policy and applauds the court decision.

The new policy, which was approved by the Organ Procurement and Transplant Network in December 2018, reduces disparity in liver allocation by extending distribution to within a 150- to 500-nautical mile radius of the donor hospital regardless of their geographic proximity to the place where the organ was initially donated. The new policy will take effect Feb. 4.
