CMS Releases Physician Sunshine Final Rule

The Centers for Medicare & Medicaid Services (CMS) released Feb. 4 a long-awaited final rule implementing the Physician Payment Sunshine Act. The rule finalizes provisions of the law that require manufacturers of drugs, devices, biologicals, and medical supplies covered by Medicare, Medicaid, or the Children’s Health Insurance Program to tell CMS about payments or other transfers of value they make to physicians and teaching hospitals. The rule also requires manufacturers and group purchasing organizations (GPOs) to disclose to CMS if any physicians have ownership or investment interests. CMS will begin data collection Aug. 1. Manufacturers and GPOs must report data for August through December of 2013 to CMS by March 31, 2014, through an electronic system CMS is still developing. CMS will release the data to the public by Sept. 30, 2014. The final rule is attached.
