CMS Proposes Six-Month Delay for Home Health CoPs

The Centers for Medicare & Medicaid Services (CMS) has issued the attached proposed rule, which would delay the effective date of new home health agency conditions of participation (CoPs) by six months, to Jan. 13, 2018. The new effective date will replace the previous cutoff date at which administrators who are employed by home health agencies are considered “grandfathered” under the new CoPs and are not obligated to comply with new personnel requirements. CMS also proposes to delay the phase-in date for requirements that home health agencies collect data before implementing data-driven performance improvement projects to July 13, 2018. Comments on the proposed rule are due June 2.

In a separate announcement, CMS announced it will pause the home health pre-claim demonstration currently underway in Illinois for at least 30 days and will not expand the program to Florida in April, as planned. CMS will notify providers at least 30 days in advance of further developments related to the demonstration via its website.
