CMS, OIG Extend Deadline for Issuance of Final Rule on ACO Waivers

The Centers for Medicare & Medicaid Services (CMS) and the Office of the Inspector General (OIG) have published the attached interim final rule extending the effectiveness of an interim final rule published in 2011, which granted waivers to certain specified fraud and abuse laws for accountable care organizations participating in the Medicare Shared Savings Program. The timeline for publishing a final rule cannot exceed three years from the date of publication of an interim final rule; however, CMS and OIG may extend the deadline by an additional year following the publication of the attached notice. CHA commented on the provisions of the original interim final rule in June 2011.
