CMS Issues Proposed Rule Expanding Qualified Entity Data Sharing

The Centers for Medicare & Medicaid Services (CMS) has issued the attached proposed rule that would allow qualified entities under the Affordable Care Act to confidentially share or sell analyses of Medicare and private claims data to health care providers, employers and others. The proposed rule, which was required by the Medicare Access and CHIP Reauthorization Act, would also require qualified entities to meet certain privacy, security and annual reporting requirements. The qualified entity program allows eligible organizations to access patient-protected Medicare data to publicly report on provider and supplier performance across multiple payers. Comments on the proposed rule are due March 29.
