CMS Delays Publication of 60-Day Overpayment Final Rule

The Centers for Medicare & Medicaid Services (CMS) has announced in the attached notice that it will delay for one year publication of a final rule requiring providers to report and return overpayments for Medicare Part A and B within 60 days of identification. The proposed rule was issued in 2012. CMS has determined that based on both public comments, including CHA’s comments, and internal stakeholder feedback, there are significant policy and operational issues that need to be resolved to address all of the issues raised by comments to the proposed rule and ensure appropriate coordination with other government agencies. Hospitals are reminded that they are currently subject to the statutory requirement to return overpayments within 60 days, even though a final regulation has not yet been published. CMS has not announced its intentions for a delay of a similar rule on Medicare C and D.
