CHA Issues Summaries of Proposed Changes to Stark and Anti-Kickback Regulations

CHA has issued detailed summaries, prepared by Health Policy Alternatives, on the proposed rules to modernize regulations under the physician self-referral law  also known as the Stark Law  and the anti-kickback statute.

The proposed rules would create new exceptions and safe harbors for certain value-based compensation arrangements and provide guidance on several key requirements that must be met for health care providers to comply with the laws. The rules are a result of input gathered from the field through various requests for information on both the Stark Law and the anti-kickback statute and listening sessions over the past several years.

CHA is analyzing the proposed rules and will engage with our national association colleagues and CHA members for their input to inform CHA’s response. CHA expects to have a draft letter for member use the week of Dec. 16. Comments are due to CMS by 2 p.m. (PT) on Dec. 31.
