California’s ‘E-Pedigree’ Law Preempted

In an effort to prevent counterfeit medication from entering the legitimate supply of prescription drugs, on Nov. 27, 2013, President Obama signed into law the Drug Quality and Security Act. The law contains provisions for a national track-and-trace system for prescription medication and preempts California’s “e-pedigree” requirements, which were set to take effect on a staggered basis beginning in January 2015. An e-pedigree is an electronic record that contains information about each transaction resulting in a change of ownership of a given dangerous drug. The Board of Pharmacy will sponsor legislation this year to repeal the now inactive e-pedigree provisions. A public notice has been posted on the California Board of Pharmacy website.
