2016 Consent Manual Now Available

CHA is pleased to announce the 2016 Consent Manual is now available. Updated to reflect changes to state and federal consent law through January 2016, the fully indexed manual contains more than 600 pages and more than 100 forms (many in Spanish) exclusively on CD. As a service to our members, one complimentary copy of the acclaimed resource will be sent to each member hospital and system CEO next week.

The Consent Manual is your one-stop resource for all legal requirements related to patient consent for medical treatment, release of medical information, refusal of treatment, reporting requirements, and more. It is designed to help keep risk managers, compliance and privacy officers, legal counsel, physicians and nurses, health information managers, emergency department staff, clinic managers, and quality managers abreast of the law and provide answers to difficult questions your staff face every day.

Some of the notable changes to the 2016 edition include:

  • The End of Life Option Act, effective June 9, 2016.
  • Rules that allow patients to identify a family member who may assist in post-hospital care.
  • Requirements for medical record requests from attorneys prior to the filing of a lawsuit, including a new form.
  • New laws that permit hospitals to disclose patient-identifiable information in certain situations.
  • Potential implications of a recent court decision on unrepresented skilled-nursing facility patients who lack capacity to make health care decisions.
  • Laws related to patient discharges, including Medicare discharge notices, discharge medication counseling requirements, discharging minors, and more.

The Consent Manual is edited by CHA’s Lois J. Richardson, Esq., vice president, privacy and legal publications, and includes legal citations.

CHA is offering a series of Consent Law seminars throughout California that run through June 1. Complete program details and registration information can be found at www.calhospital.org/consent-law.
